Public Notice: Proposed Settlement with Port of Toledo Boatyard for Clean Water Act Violations in Oregon
Summary
EPA is providing notice of a proposed administrative penalty settlement with the Port of Toledo (respondent) for violations of the Clean Water Act at its facility located in Toledo, Oregon.
EPA alleges that the respondent failed to comply with Oregon’s 1200-Z Industrial Stormwater Discharge General Permit (#ORR203146) at the Port of Toledo Boatyard facility. The 1200-Z permit covers discharges of pollutants into the Yaquina River.
Alleged violations include failure to minimize exposure, missed monthly routine site inspections and discharge visual assessments, and missed annual employee training as required by the permit.
This action is being simultaneously commenced and concluded in an Expedited Settlement Agreement. Under the proposed agreement (see "Related Documents" below), the respondent has agreed to pay a civil penalty of $1,648.
